Please find below the terms and conditions relating to the Services offered by Food by Beth. By engaging our Services, Client agrees to abide by these Terms.
1. Services:
a. Food by Beth aims to provide the highest quality service to my clients, Food by Beth offers a range of services, the type of service and timescale will be agreed with the client upon booking.
b. In extreme circumstances Food by Beth retain the right to subcontract any portion of the Services to third parties, maintaining quality and confidentiality standards.
2. Payment Terms:
a. Payment shall be made according to the agreed terms outlined in the invoice. Typically, 30 days, unless stated otherwise.
b. Food by Beth reserves the right to enforce a late payment penalty fee of 10% of the outstanding balance on the invoice per week until payment is received in full.
c. All payments shall be made in the currency specified in the invoice and to the bank account specified on the invoice.
3. Cancellation:
a. In the event of cancellation by the Client, a notice period of 10 days is required.
b. Cancellations made after the 10 days of the notice period may incur charges equivalent to 25% of the total project fee. Cancellations made after 5 days of the notice period may incur charges equivalent to 50% of the total project fee. Cancellations made after 3 days of the notice period may incur the total project fee charge.
c. Food by Beth reserves the right to cancel the Services at any time due to unforeseen circumstances. In such cases, the Client shall be refunded for any payments made for Services not rendered.
4. Recipe Amendments:
a. The Client is entitled to request amendments to the recipes developed. Reasonable amendments shall be made free of charge within the first round of revisions. Any further rounds of amendments may incur additional charges at £50 per recipe amendment.
5. Confidentiality:
a. Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the provision of Services.
b. Food by Beth shall not disclose any recipes, techniques, or other confidential information belonging to the Client without prior written consent.
6. Complaints:
a. Food by Beth hopes you are happy with the services you have received, if you do have a complaint please contact; hello@foodbybeth.co.uk.
7. Intellectual Property:
a. All intellectual property rights, including but not limited to recipes, food styling concepts, images and videos developed during the provision of Services shall belong to the Client upon full payment.
b. The Client grants the Food by Beth the right to use any materials produced for promotional purposes.
8. Privacy:
a. Food by Beth will only hold necessary personal information such as contact details, all other information will be deleted. Personal information will never be given or sold for commercial use.
9. Liability:
a. Food by Beth shall not be liable for any loss, damage, or injury arising from the use of the recipes or food styling concepts provided.
b. The Client agrees to indemnify and hold harmless Food by Beth from any claims, damages, or liabilities arising from the Client's use of the Services.
c. Food by Beth shall not be liable for any illness caused from consuming food produced for photography, it is not produced for consumption and therefore is consumed at the Clients risk.
10. Entire Agreement:
a. These Terms constitute the entire agreement between the parties concerning the provision of Services and supersede all prior agreements and understandings, whether written or oral.
By engaging our Services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions. These Terms may be updated from time to time, and it is the Client's responsibility to review them periodically.
